Trade Mark Registration and Protection
Under the Trademarks Act 2019, a trade mark can be any sign capable of graphical representation that distinguishes your goods or services.
- Words, logos, shapes, colours, sounds and scents can all be registered.
- Registration with MyIPO lasts 10 years and can be renewed indefinitely.
- Since 27 December 2019, you can extend protection abroad through the Madrid Protocol.
- A registered mark is far easier to enforce than an unregistered one.
We search and clear new brands, file and prosecute applications, respond to objections, handle oppositions and manage renewals and portfolios.
Trade Mark Infringement and Passing Off
A registered owner can act against anyone who uses an identical or similar mark for identical or similar goods or services without consent, where confusion is likely. Remedies include:
- Injunctions to stop the infringement.
- Damages or an account of profits.
- Delivery up or destruction of infringing goods.
If your mark is not registered, you may still sue for passing off by proving goodwill, a misrepresentation and damage. We send cease and desist letters, negotiate undertakings and bring proceedings in the Intellectual Property Courts.
Copyright and Online Infringement
Copyright under the Copyright Act 1987 arises automatically when an original work is created. No registration is needed.
- It protects literary, musical and artistic works, films, sound recordings, broadcasts and software.
- You may notify your copyright to MyIPO as evidence of ownership.
- The Act was amended in 2022 to tackle illegal streaming devices and services.
We act on copying, software piracy, online infringement and takedowns, licensing disputes and ownership of works created by employees and contractors.
Patents and Utility Innovations
A patent under the Patents Act 1983 protects an invention that is new, inventive and industrially applicable.
- Protection lasts 20 years from the filing date, provided annual fees are paid.
- Utility innovations protect inventions that are new and industrially applicable but may not meet the inventive step requirement.
- We advise on patentability, ownership, employee inventions and licensing.
We act in infringement and invalidation proceedings, working with registered patent agents on filing and prosecution.
Industrial Designs
A registered industrial design under the Industrial Designs Act 1996 protects new features of shape, configuration, pattern or ornament applied to an article by an industrial process.
- Protection lasts for an initial five years.
- It can be renewed for four further five-year terms, up to 25 years.
- We file applications and act on infringement and invalidation disputes.
Anti-Counterfeiting and Trade Secrets
Counterfeit goods damage both revenue and reputation. To stop them, we can:
- File complaints with the Ministry of Domestic Trade and Cost of Living (KPDN), which enforces the offence provisions of the Trademarks Act 2019 and the Trade Descriptions Act 2011.
- Request border measures through the Royal Malaysian Customs Department under the Trademarks Act 2019.
- Bring civil proceedings for infringement or passing off.
Trade secrets and confidential information are protected through contracts and the law of confidence rather than registration. We draft confidentiality and restraint clauses, and obtain urgent injunctions where information has been taken.
Frequently Asked Questions
A registered trade mark is protected for 10 years from the filing date and can be renewed for further 10-year periods indefinitely, as long as the renewal fees are paid.
Yes. Since Malaysia joined the Madrid Protocol on 27 December 2019, you can file an international application through MyIPO designating other member countries, based on your Malaysian application or registration.
No. Copyright arises automatically when an original work is created and fixed in a material form. You may voluntarily notify your copyright to MyIPO, which can help as evidence of ownership in a dispute.
Infringement protects a registered trade mark, while passing off protects the goodwill of a business whether or not its mark is registered. Passing off requires proof of goodwill, misrepresentation and damage, so a registered mark is usually easier to enforce.
A patent lasts for 20 years from the filing date, provided the annual fees are paid. After it expires, anyone may use the invention.
A registered industrial design is protected for five years from the filing date and can be renewed for four further five-year terms, up to a maximum of 25 years.
You can send cease and desist letters, file complaints with KPDN, which enforces the Trademarks Act 2019 and the Trade Descriptions Act 2011, request border measures through the Royal Malaysian Customs Department, and bring civil proceedings for infringement or passing off in the Intellectual Property Courts.
There is no registration for trade secrets. They are protected through confidentiality and restraint clauses in contracts and through the law of confidence, which allows the court to grant injunctions and damages where confidential information is misused.
