CIPAA (Construction Industry Payment and Adjudication Act 2012)
CIPAA was enacted to address cash flow issues in the construction industry by providing a fast-track adjudication mechanism for the recovery of unpaid sums. It applies to construction contracts made in writing relating to construction work carried out wholly or partly in Malaysia.
Our firm provides legal advice and representation at all stages of CIPAA proceedings, ensuring strict compliance with statutory timelines and procedural requirements, which are critical to the success of adjudication claims.
Our CIPAA services include, but are not limited to:
• Advising on the applicability of CIPAA to construction contracts
• Preparation and response to payment claims and payment responses
• Representation in adjudication proceedings
• Appointment and challenge of adjudicators
• Enforcement of adjudication decisions
• Applications to set aside or stay adjudication decisions
