Lawyer Khoo Ai Theng Secures Major Win in Unfair Dismissal Case Against Heineken
November 2024 – Kuala Lumpur
In a significant victory for employee rights, senior legal practitioner Khoo Ai Theng successfully represented a former senior IT manager in a high-profile unfair dismissal case against Heineken Malaysia, resulting in the company being ordered to pay RM893,200 in compensation.
The case, which drew public attention due to the stature of the employer and the compensation amount awarded, centered around claims of unjust termination that failed to follow proper procedures and breached principles of natural justice.
Representing the former employee, Khoo Ai Theng argued that the dismissal lacked substantive justification and was procedurally flawed. The court agreed, ruling that the termination was indeed unjust and awarded a substantial sum covering back wages and compensation in lieu of reinstatement.
“This case sets an important precedent and serves as a reminder to employers that termination must be handled in strict accordance with the law,” Khoo said following the verdict. “No matter how senior or junior an employee is, they are entitled to fair treatment and due process.”
Khoo emphasized that the win also highlights the need for transparent internal disciplinary frameworks and proper documentation before employers take any action to dismiss staff.
The court’s ruling is seen as a milestone in the protection of employees in Malaysia’s corporate landscape and underscores the growing importance of legal recourse in employment disputes.
