Understanding how it works helps you manage your rights and obligations from the start of a project to its completion.

What the PAM contract is

The PAM contract is a standard-form building contract designed for use on private sector construction projects. Rather than drafting a fresh agreement for every job, parties adopt the PAM form, which already contains tried-and-tested provisions covering the main aspects of a building project.

Using a recognised standard form has real advantages. The terms are familiar to the industry, the risk allocation is broadly understood, and there is a body of practice around how the clauses operate. This reduces uncertainty and the time spent negotiating from scratch.

How it allocates risk

A central function of any construction contract is to decide who carries which risks, and the PAM form does this through its detailed clauses. It sets out the contractor’s obligations to carry out and complete the works, the employer’s obligations to make payment, and the role of the architect or contract administrator in overseeing the project.

The PAM contract contains a structured payment mechanism, typically based on interim certificates issued as the work progresses, with retention held back and released at defined stages. Understanding this machinery is essential to claiming what you are owed at the right time.

It is worth remembering that CIPAA sits alongside the contract. Even where the PAM form governs the project, CIPAA gives you a statutory right to adjudication for payment disputes and renders conditional payment clauses void. The contract and the Act work together.

Common areas of dispute

Disputes under the PAM form often centre on variations, extensions of time, liquidated damages, and the valuation of work. Many of these can be avoided by following the contractual procedures carefully, particularly around instructions and notices. Where a dispute does arise, the form’s own dispute resolution provisions, together with the right to adjudication under CIPAA, provide the routes to resolution.
