Trademarks are registered for an initial term of 10 years and can be renewed periodically as prescribed by the Act. This term is counted from the date of application.
To maintain a trademark, the renewal application must be submitted between one and two months before the existing registration’s expiration. If the application is not filed within this window, the Registrar will notify the trademark owner of the upcoming expiration.
If the renewal application is not submitted on time, the Registrar will remove the trademark from the Register. However, the trademark may be restored under certain conditions. If more than a year has passed since the last registration’s expiration, the trademark cannot be renewed.
